1Agreement to These Terms
These Terms govern your use of Mood Bank. By applying for membership, creating an account, or using Mood Bank after approval, you agree to these Terms and the Privacy Policy.
Mood Bank is operated by Ced & Dunn, LLC.
2What Mood Bank Is
Mood Bank is an adult membership institution centered on mental wealth. It is designed to help members understand what is happening, decide what matters, carry forward what they intentionally choose, and reach appropriate support when the right next move exists outside Mood Bank.
Mood Bank is not a bank, lender, brokerage, investment adviser, insurance company, therapy practice, medical provider, crisis service, or substitute for qualified professional care.
3Eligibility and Membership
Membership is currently limited to adults age 18 or older in the United States. Application does not guarantee admission.
Mood Bank may verify eligibility, identity, and mobile-phone ownership and may conduct institutional review before approving membership. A pending application is not active membership.
Mood Bank may approve, decline, request more information, suspend an admitted member, or close access where required by Product policy, safety, law, fraud prevention, or these Terms.
4Your Account
You are responsible for providing accurate information, maintaining the security of your account credentials, and notifying Mood Bank if you believe your account has been compromised.
Your account is personal to you. You may not sell, transfer, impersonate another person, create deceptive accounts, or use Mood Bank to gain unauthorized access to another member's information.
5How the Product Works
Mood Bank includes experiences such as Today, Explore, Tools, Investments, Journal, Anchors, Saved, Vault, Branch, Safety, and related account and mental-wealth features. Product availability may change as Mood Bank develops.
Some Product activity is transient by default. Mood Bank does not promise to preserve every session, draft, click, or interaction. Durable continuity exists where the Product clearly allows you to create or save something for later.
6Investments, Anchors, Journal, and Tools
An Investment is a commitment you deliberately choose to carry forward. Most Anchors are people, dates, words, or commitments you deliberately choose to remember. Mood Bank also creates one private permanent system Anchor for each member using the name he chooses to be called: his 12-year-old self. That Anchor is a reflective Product reference, not a diagnosis or statement that any particular childhood event occurred, and any prompt connected to it may be skipped. Journal is private autobiographical space. Tools are instruments intended to help with a moment and may be transient unless the Product explicitly offers a save or Journal action.
These Product concepts do not represent financial investments, deposits, withdrawals, accounts, balances, or banking services in the legal or financial sense.
7Vault
Vault allows members to Ask or Share under Mood Bank governance. Content may be anonymous to other members while remaining attributable to Mood Bank for moderation, safety, and accountability.
You may not use Vault to threaten, harass, exploit, impersonate, dox, solicit illegal activity, distribute unlawful content, spam, or deliberately undermine the safety of other members. Mood Bank may review, restrict, remove, or preserve governed records as required by its moderation and safety processes.
8Branch and External Resources
Branch may help members identify qualified real-world resources, providers, organizations, opportunities, or practical support. Mood Bank may curate, verify, review, or classify resources, but external organizations remain responsible for their own services, availability, pricing, qualifications, licensing, conduct, and privacy practices.
A listing, referral, benefit, or partner relationship is not a guarantee, medical endorsement, financial endorsement, or promise of outcome.
9Safety and Emergencies
Mood Bank is not a crisis responder and does not provide continuous monitoring. If you or another person is in immediate danger, contact 911 or your local emergency services. In the United States, call or text 988 for crisis or urgent emotional support.
For non-emergency clinical needs, seek a qualified professional. For legal, housing, benefits, financial, or other practical needs, use an appropriate qualified resource. Mood Bank may help identify options, but the institution does not replace those professionals or services.
10Communications
Verified phone ownership is part of identity and security. It is not consent to receive optional SMS communications.
Mood Bank may send required account, membership-status, or security notices under its operational communication policy. Optional email, SMS, editorial, event, reminder, or push communications require the permissions applicable to those channels. You can change optional communication preferences where the Product provides those controls.
11Calendar, Maps, and Connected Services
Some Mood Bank features may connect with services such as calendars, maps, or place providers when you deliberately choose to use them. By connecting an external service, you authorize Mood Bank to transmit the information necessary to perform the action you requested.
External services are also governed by their own terms and privacy practices. Mood Bank is not responsible for an external provider's independent service availability or policies.
12Partnerships and Member Benefits
Mood Bank may work selectively with employers, universities, brands, providers, institutions, restaurants, professional services, membership organizations, and other partners that can add value to members.
A Mood Bank partnership does not give a partner access to private member content. Journal entries, Today inputs, Investments, Safety activity, private context, and other intimate Mood Bank content are not partner inventory.
Benefits, offers, discounts, eligibility requirements, availability, and partner terms may change and may also be subject to the partner's own conditions.
13Your Content
You retain ownership of content you create, subject to the limited permissions required to operate the Product. For example, if you intentionally publish or submit content to a governed member-facing surface such as Vault, you authorize Mood Bank to store, moderate, display, and administer that content for that Product purpose.
Private content such as Journal entries is not automatically licensed for advertising, partner targeting, public display, or unrelated Product uses.
14Mood Bank Intellectual Property
Mood Bank branding, Product design, software, original content, methods, text, graphics, audio, video, and other institutional materials are protected by applicable intellectual-property laws.
These Terms do not give you permission to copy, resell, reproduce, distribute, reverse engineer, or commercially exploit Mood Bank intellectual property except where law expressly permits it or Mood Bank provides written permission.
15Acceptable Use
You may not use Mood Bank to violate law, abuse or harass another person, interfere with Product security, gain unauthorized access, scrape or systematically extract protected member information, distribute malware, impersonate Mood Bank, misuse member benefits, or attempt to defeat eligibility, identity, moderation, or safety controls.
16Suspension and Termination
Mood Bank may suspend or terminate access where required to protect members, enforce these Terms, respond to fraud or abuse, comply with law, or administer the institution. Suspension applies to an admitted member and is distinct from an application decline.
You may also permanently delete your account through the Product where that capability is available. Permanent deletion is destructive and ends member access.
17No Guarantee of Availability
Mood Bank is provided on an evolving basis. Features, integrations, content, partners, resources, and availability may change. We do not guarantee uninterrupted or error-free operation, the continued availability of any particular external provider, or a particular result from using Mood Bank.
18Disclaimer of Professional Advice
Nothing in Mood Bank constitutes medical, mental-health, legal, financial, investment, tax, or other licensed professional advice. Information and Tools are provided for general support, reflection, preparation, navigation, or practical use. Seek qualified professional advice where your situation requires it.
19Limitation of Liability
To the fullest extent permitted by applicable law, Mood Bank and its operator are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, inability to use, or reliance on Mood Bank or an external resource.
Nothing in these Terms limits rights or liability that cannot legally be limited.
20Changes to These Terms
Mood Bank may update these Terms as the Product, operating structure, legal requirements, or institutional policies change. Material changes will be communicated through an appropriate member-facing channel as required. Continued use after updated Terms take effect may constitute acceptance where permitted by law.
